The following terms and conditions apply to the current competition featuring Thomas Klotz:
1. Organiser
The organiser of the competition is Hotel ZWEITE HEIMAT GmbH, Schwanenwik 30, 22087 Hamburg. The competition will be announced by the company’s partner, Thomas Klotz, via a post on his Instagram channel (partner content). The competition will therefore be accessible on the Instagram channel of ‘ZWEITEN HEIMAT’ and the Instagram channel of ‘Thomas Klotz’ with the handle ‘@thomas.klotz’. The competition is not affiliated with Instagram or Meta and is neither sponsored, supported nor organised by Meta. The organiser is the sole point of contact and the party responsible. All questions, comments or complaints regarding the competition must be addressed directly to the organiser, Hotel ZWEITE HEIMAT, and not to Meta or Thomas Klotz.
2. Eligibility
All Instagram users who are aged 18 or over at the time of entry are eligible to take part. By entering the competition, participants accept these terms and conditions. Hotel ZWEITEN HEIMAT GmbH reserves the right to exclude participants from the competition in the event of a breach of these terms and conditions or attempted manipulation – for example, by commenting on content that contravenes applicable law or is contrary to public decency. This also includes participation using multiple Instagram accounts.
3. Entry period
The entry and promotion period begins on Tuesday 30 June 2026 at 10:00 and ends on Wednesday 15 July 2026 at 23:59.
4. How to enter
To enter the competition, participants must comment on the competition post on the Instagram channel @hotel_zweite_heimat_spo or @thomas.klotz within the entry period.
Participants may, if they wish, tag other people in the comments who would also be delighted to win. Tagging other people does not affect the chances of winning.
Following the Instagram accounts @hotel_zweite_heimat_spo and @thomas.klotz, as well as liking the post, is a prerequisite for entering the competition.
Only one entry per participant will be accepted. Posting multiple comments will not increase your chances of winning.
5. Exclusion from participation
Owners, employees and other staff of the organiser, and all staff of third-party companies involved in running this competition, as well as persons who are family members of the aforementioned individuals or who live in a shared household or similar living arrangement with the aforementioned individuals, are excluded from taking part. Participation in the competition on behalf of another person is not permitted. Persons who submit content that is criminal, pornographic, harmful to minors, racist or otherwise extremist, discriminatory or otherwise contrary to applicable law or public decency will be excluded from the competition and their comment(s) may be deleted.
6. Prize
Hotel ZWEITEN HEIMAT GmbH will draw the following prize from among all participants who have taken part in the competition during the competition period, in accordance with the rules of participation:
Two nights’ accommodation in a ‘Große Stube’ room for two people, including breakfast, a three-course meal on one of the evenings and use of the spa facilities.
The prize is non-transferable and cannot be exchanged for cash.
7. Prize Draw
The prize will be drawn at random via a computerised random selection system from among all participants who meet the above conditions. Each user has one chance of winning. Posting multiple comments does not increase the likelihood of winning. A maximum of one prize will be awarded per participant.
8. Closing date for entries, notification of winners, prize handover and dispatch
Entries may only be submitted during the entry period; the closing date for entries is 15 July 2026 at 23:59.
Prize claims are non-transferable. There is no enforceable right to payment of the prizes (Section 762 of the German Civil Code (BGB)). No liability is accepted for the dispatch of prizes, unless the loss or damage is due to wilful misconduct or gross negligence on the part of the organiser.
The organiser reserves the right to exclude any participant from the competition at any time if they have attempted to manipulate the competition, either themselves or through third parties. If the participant has received the prize by providing false information, through manipulation or deception, the organiser reserves the right to reclaim the prize or to award it to someone else.
9. Notification of the prize
Once the competition period has ended (no later than 17 July 2026), the winner will be notified via the comments section of the Instagram post and by private message on Instagram. The winner must provide their address details within 3 working days of being notified of their win. If a winner does not come forward within this period, the prize in question will be raffled off again amongst all participants. Participants are responsible for ensuring the accuracy of the details they provide. If the prize cannot be correctly awarded due to incorrect details provided during the competition, the participant’s claim to the prize will lapse.
10. Dispatch of prizes
Prizes will be dispatched no later than 14 working days after the winner has been contacted. No liability is accepted for the dispatch of prizes, unless the loss is due to wilful misconduct or gross negligence on the part of the organiser or its agents.
11. Organiser’s Rights/Disclaimer
The competition is governed by the laws of the Federal Republic of Germany.
The organiser bears unlimited liability for wilful misconduct and gross negligence, as well as for damage resulting from injury to life, limb or health.
In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence, the organiser’s liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for breaches of duty due to slight negligence is excluded.
The organiser accepts no liability for technical faults, network failures, electronic malfunctions or faults with the Instagram platform that may affect participation in the competition.
The organiser reserves the right to terminate the competition early or to amend it for good cause, provided that proper conduct of the competition cannot be guaranteed for technical or legal reasons.
Should any individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.
Legal recourse is excluded.
12. Data Protection
In the context of the competition, participants’ personal data (e.g. Instagram username and, in the event of a win, name and address) will be processed solely for the purpose of organising and administering the competition.
The legal basis for the processing is Article 6(1)(b) of the GDPR (implementation of pre-contractual measures or performance of a contract in connection with the competition). The data will only be stored for as long as is necessary for the organisation of the competition. Once the competition has been fully concluded, the data will be deleted, provided that no statutory retention obligations prevent this.
Data will only be disclosed to third parties to the extent necessary for the organisation of the competition (e.g. to a delivery service provider for the dispatch of the prize).
Participants have the right at any time to access the personal data stored, as well as to have it rectified, erased or the processing restricted. There is also a right to data portability and a right to lodge a complaint with a competent data protection supervisory authority.
The provision of personal data is required for participation in the prize draw. Without this data, participation or
delivery of the prize.
The winner will be notified via Instagram. The winner’s first name will only be published on the organiser’s channels if the winner has expressly consented to this.
